Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zyph platform ("Service"), operated by Zyph ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • Account means your registered user account on the Service.
  • Content means any data, text, links, images, or other materials you submit through the Service.
  • Workspace means a collaborative environment within the Service where you and your team manage links and resources.
  • Short Link means a shortened URL created through the Service that redirects to a destination URL you specify.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access the Service, you must create an Account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right.
  • Distribute malware, phishing links, or other harmful content.
  • Create links that redirect to illegal, fraudulent, or deceptive content.
  • Engage in spamming, unsolicited messaging, or abusive behaviour.
  • Attempt to gain unauthorised access to the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to infringe upon intellectual property rights of others.
  • Circumvent rate limits, access controls, or security measures.

We reserve the right to suspend or terminate your Account and remove Content that violates these Terms without prior notice.

5. Subscription Plans and Payments

The Service offers free and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly or annually). All fees are non-refundable except where required by law. We may change pricing with 30 days' advance notice. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

6. Intellectual Property

The Service, including its design, code, trademarks, and documentation, is owned by us and protected by intellectual property laws. You retain ownership of your Content but grant us a limited licence to host, process, and display it as necessary to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described therein.

8. Analytics and Tracking

The Service collects analytics data about clicks on Short Links, including IP addresses (hashed for privacy), user agents, referrers, and geographic information. This data is used to provide analytics features to you and is subject to workspace-level data retention policies.

9. API Usage

If your plan includes API access, you may use our API subject to the rate limits and usage restrictions of your plan. API keys are confidential and must not be shared publicly. We may revoke API access for misuse.

10. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" and "as available". We may perform scheduled maintenance with reasonable advance notice where possible.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising from your use of the Service, your Content, or your violation of these Terms.

13. Termination

You may close your Account at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice within the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
